Subject: Important Update: HUD's New Smoke Alarm Rule Effective December 31, 2024

We are reaching out to inform you of an important update from the U.S. Department of Housing and Urban Development (HUD) concerning new regulations on smoke alarms that will take effect on December 31, 2024. As a valued participant in the Housing Choice Voucher (HCV) Program, it is essential that you are aware of and comply with these new requirements to ensure the safety and well-being of your tenants. 

Overview of the New Rule:

HUD's new rule mandates that all rental properties participating in the HCV Program must have smoke alarms that meet specific standards for installation and functionality. This rule is designed to enhance tenant safety by ensuring that all units are equipped with reliable smoke detection systems. 

Key Requirements:

  1. Installation: One (1) Smoke alarm must be installed in each bedroom, one (1) in the immediate vicinity of the bedrooms mounted on the ceiling in the hallway (Sleeping Area) and at a minimum on each level of the dwelling unit, including basements. 
  2. Standards: All Smoke alarms in federally assisted housing to be either hardwired or have sealed, 10-year batteries. 
  3. Maintenance: Landlords are responsible for ensuring that smoke alarms are in working order at the beginning of each new tenancy and must provide tenants with instructions for testing and maintaining the alarms. 

Action Steps for Compliance: 

  • Review and assess the current smoke alarm systems in your rental properties to ensure they meet the new standards. 
  • Plan for the installation or replacement of smoke alarms where necessary to comply with the new rule by the effective date. 
  • Educate your tenants on the importance of smoke alarm maintenance and provide them with the necessary information to test and maintain the alarms.
